The Rational Project may change, amend, supplement, or remove any part of these terms at any time, at its own discretion, to reflect changes to the site, to our practices, or to applicable law. Except where these terms expressly say otherwise, none of the Content may be reused without The Rational Project's prior written consent: this includes reproducing it, publishing or republishing it elsewhere, translating or otherwise adapting it, extracting or re-encoding it into another format, and transmitting, broadcasting, or making it available by any other means — whether on another server, computer, or website, whether mirrored or embedded within another page, and regardless of whether the purpose is commercial.
You may view, print, or download excerpts of the Content for your own personal, non-commercial, informational use, provided that: (1) you keep all copyright, trademark, and other proprietary notices intact; (2) you do not modify the Content in any way; (3) you do not use it to imply any endorsement, affiliation, or sponsorship by The Rational Project that does not exist; and (4) you do not republish or redistribute it on a networked computer, on any other website, or through any other medium.
Articles submitted and published by Architects through the site remain the intellectual property of their respective authors. By submitting an article, an author represents that they hold the necessary rights to it and grants The Rational Project a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt for display purposes, and publicly display that article on the site for as long as it remains published, and to retain an archival copy after removal for legal and record-keeping purposes.
Acceptable use
You agree to use this site lawfully, honestly, and in good faith, for its intended purpose. Without limiting the general rule above, you agree that you will not, whether directly or through any device, program, algorithm, or other automated or manual method:
- put the site or its Content to any use that is unlawful, that these terms don't permit, or that would encourage conduct infringing the rights of The Rational Project or of a third party;
- disrupt, or try to disrupt, the normal functioning of the site, a transaction carried out on it, or another visitor's use of it, whether through a device, software, or routine built for that purpose;
- pretend to be, or claim an affiliation with, a person or organization you are not — including The Rational Project itself;
- place a disproportionate or unreasonable load on the site's infrastructure, or on the systems and networks operated by The Rational Project or its technical providers;
- harvest data from the site through robots, spiders, crawlers, deep links, page-scraping software, or any comparable automated or manual technique, or bypass its intended navigation and structure to obtain information by means other than those we provide for that purpose — this does not extend to the R Index contribution tool, built precisely to receive structured product submissions;
- scan, probe, or test for weaknesses in the site's security, or attempt to defeat any authentication or access-control mechanism it relies on, whether on the site itself or on a network connected to it;
- falsify headers or other identifying information to conceal or misstate the origin of a message or transmission you send us through the site;
- seek unauthorized entry into any account, page, feature, or connected system, whether through stolen credentials, guessed passwords, or any other improper means.
We may suspend, restrict, or terminate access for anyone who violates these rules, and reserve the right to take any technical or legal measure we consider appropriate in response.
Accounts
Some features of the site — submitting a project or event, writing articles, contributing to the R Index — require creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not you authorized it. If you believe your account has been compromised or used without your authorization, contact us immediately.
Published articles are subject to a per-author limit and to a review step before publication. The Rational Project may decline to publish, or may remove, any content that is inaccurate, unlawful, infringing, or otherwise inappropriate, at its own discretion.
Links to other sites
This site may link to third-party websites — partner organizations, social media, or resources referenced in our articles — for your convenience. These linked sites are not under our control, we have not reviewed all of the content they contain, and The Rational Project is not responsible for their content, their practices, or the consequences of visiting them. Visiting a linked site is at your own discretion and own risk, and your interactions with it are governed by that site's own terms and policies, not by these terms.
Disclaimer
The Rational Project is a volunteer-run, non-profit association with limited resources. We do our best to keep the site accurate, safe, and available, but we can't promise it will always be so.
Accordingly, the site, its Content, and any feature offered through it come "as is" and "as available," to the fullest extent French law allows. We don't promise that the site will be free of errors, that it will run without interruption, that any fault will be fixed, that it will withstand every security threat, or that using it will produce a particular result — and we can't guarantee that a file offered for download from the site will never carry a virus or other harmful component.
Information published on the site — including the R Index and the data behind it, which grows progressively from volunteer contributions and remains a work in progress — should not be treated as professional, financial, purchasing, or other advice. This "as is" disclaimer, and the limitation of liability below, apply to the public website and its Content. They do not apply to commercial deliverables provided under a separate sponsorship, partnership, or services agreement — such as reporting, data access, event participation, or logo placement under a paid arrangement — which are governed by the terms of that specific agreement rather than by this notice.
Limitation of liability
Even where The Rational Project has been made aware that such damages were possible, and to the fullest extent French law allows, neither the association nor its founder, directors, or volunteers can be held liable for indirect, special, incidental, consequential, or exemplary damages — including lost profit, lost opportunity, or lost data — connected with your inability to use the site, your use of it, or your access to it or its Content.
Nothing in this notice excludes or limits any liability that cannot lawfully be excluded or limited under French law, such as liability for death or personal injury, for fraud, or for gross negligence or willful misconduct.
Termination
The Rational Project may suspend or terminate your access to the site or your account, with or without prior notice, in particular where: (1) you ask us to, such as through an account-deletion request; (2) an unexpected technical, operational, or security issue affects the site; (3) the site or a service offered through it is discontinued or materially changed; (4) a competent judicial, administrative, or law-enforcement authority requires it; or (5) you have violated these terms or applicable law.
You may also request the deletion of your account at any time by contacting us. Termination of your access does not affect any provision of these terms that, by its nature, is intended to survive termination, including the sections on intellectual property, disclaimer, limitation of liability, and governing law.
Governing law
These terms are governed by French law. Before initiating any judicial proceedings, the parties agree to make a good-faith effort to resolve any dispute amicably. Failing an amicable resolution, any dispute relating to your use of the site will be submitted to the competent French courts, without prejudice to any mandatory consumer-protection rules that may apply in your place of residence.
